Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "Customer," or "you") and Lotus Salon by Valerie, LLC ("Lotus Salon Studio," "we," "us," or "our"), a limited liability company organized under the laws of Arizona.
By booking an appointment, using our services, or accessing our website at https://lotussalonstudio.com, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our services.
Important: These Terms may be updated from time to time. Your continued use of our services after any changes constitutes acceptance of the updated Terms.

Lotus Salon Studio provides professional hair and beauty services including but not limited to:
Hair Services
- Hair cutting and styling
- Hair coloring and highlighting
- Hair treatments and conditioning
- Blowouts and styling
- Special occasion styling
Beauty Services
- Eyebrow waxing and shaping
- Facial waxing services
- Lash and brow tinting
- Makeup application
- Consultation services
Service Customization: All services are customized to individual client needs. Final service details, duration, and pricing may vary based on hair condition, length, and specific requirements discussed during consultation.
Booking and Appointment Policies
Appointment Booking
- Appointments must be booked through our online booking system (Hummingbook) or by direct contact
- All appointments require a valid name, phone number, and email address
- First-time clients must provide additional information including any allergies or sensitivities
- Appointment requests are confirmed only after receiving confirmation from our salon
- Same-day appointments are subject to availability and may require phone confirmation
Cancellation Policy
- 24-Hour Notice Required: Cancellations must be made at least 24 hours before appointment time
- Late Cancellations: Cancellations with less than 24 hours notice may incur a 50% service fee
- No-Show Policy: No-shows will be charged the full service amount
- Emergency Exceptions: Medical emergencies and severe weather may be considered for fee waiver
- Repeat Violations: Multiple late cancellations may result in requiring deposit for future bookings
Arrival and Wait Time
- Please arrive 10 minutes early for your appointment to complete any necessary paperwork
- Arrivals more than 15 minutes late may result in appointment rescheduling
- Late arrivals may result in shortened service time to accommodate other clients
- We reserve the right to reschedule appointments due to unforeseen circumstances
Rescheduling
- Appointments may be rescheduled up to 24 hours in advance without penalty
- Multiple rescheduling requests may require a deposit to hold future appointments
- Seasonal high-demand periods may have restricted rescheduling options
- Emergency rescheduling will be accommodated when possible

Payment Timing
- Payment is due at time of service
- Deposits may be required for lengthy services
- Package deals require full payment upfront
- Gift certificates must be paid in full at purchase
- Outstanding balances accrue interest after 30 days
Pricing and Fees
- All prices are subject to change without notice, but confirmed prices will be honored for scheduled appointments
- Pricing may vary based on hair length, thickness, condition, and specific service requirements
- Additional charges may apply for services requiring extra time or materials beyond standard estimates
- Gratuities are appreciated but not required; standard gratuity is 18-25% of service cost
- Arizona state sales tax will be added to all services as required by law
Refunds and Disputes
- Service Satisfaction: We strive for 100% satisfaction and will work to address any concerns
- Corrective Services: Complimentary corrections available within 7 days of original service
- Refund Policy: Partial refunds may be considered for significant service issues when resolution isn't possible
- Dispute Resolution: Payment disputes must be raised within 30 days of service
- No Refunds: Completed services are generally non-refundable except in cases of significant service failure
Client Responsibilities and Conduct
Health and Safety Disclosure
- Clients must disclose any allergies, skin sensitivities, or medical conditions that may affect services
- Pregnancy, recent chemical treatments, and medications must be disclosed before color or chemical services
- Clients with contagious conditions or open wounds may be refused service for health and safety reasons
- Clients under the influence of drugs or alcohol will be refused service
- COVID-19 symptoms or recent exposure must be disclosed, and service may be rescheduled
Professional Conduct
- Respectful treatment of staff and other clients is required at all times
- Harassment, discrimination, or abusive behavior will result in immediate service termination
- Cell phone use should be minimized during services for safety and respect
- Children must be supervised at all times and may not be left unattended
- Excessive noise or disruptive behavior may result in service termination
Service Preparation
- Arrive with clean, dry hair unless otherwise instructed
- Remove contact lenses before facial services if requested
- Wear appropriate clothing that can be protected or easily cleaned
- Bring reference photos for desired looks when applicable
- Follow pre-service instructions provided during booking or consultation
Liability Limitations and Disclaimers
Service Risks and Limitations
Acknowledgment of Risk: All beauty and hair services carry inherent risks including but not limited to allergic reactions, skin irritation, hair damage, or unsatisfactory results. By booking services, you acknowledge these risks.
- Color services may not achieve exact desired results due to individual hair characteristics
- Chemical services may cause damage to previously processed or fragile hair
- Patch tests are recommended but not guaranteed to prevent all reactions
- Results may vary based on individual hair type, condition, and maintenance
- Some services may require multiple appointments to achieve desired results
Limitation of Liability
Maximum Liability: Our total liability for any claim arising from our services shall not exceed the amount paid for the specific service in question.
- We are not liable for indirect, consequential, or punitive damages
- We are not responsible for client's loss of work, social events, or opportunities
- Liability is limited to corrective services or partial refund at our discretion
- Claims must be made within 30 days of service to be considered
- Photography and documentation may be required for claim evaluation
Insurance and Professional Standards
- Lotus Salon Studio maintains professional liability insurance as required by Arizona law
- All services are performed by licensed professionals in accordance with state regulations
- We follow all health department guidelines and sanitation standards
- Professional judgment may override client requests if services would cause harm
- We reserve the right to refuse service that compromises safety or professional standards
Intellectual Property and Media
Photography and Social Media
- We may photograph services for portfolio, marketing, and social media purposes
- Client consent will be obtained before posting identifiable photos
- Clients may request not to be photographed at any time
- We reserve rights to use before/after photos for professional marketing
- Clients may request removal of their photos from our marketing materials
Proprietary Information
- Our techniques, formulations, and methods are proprietary and confidential
- Clients may not record or photograph our processes without permission
- Trade secrets and professional methods are protected intellectual property
- Client information and service records are confidential and protected
Governing Law and Dispute Resolution
Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Maricopa County, Arizona.
Dispute Resolution Process
- Direct Communication: Disputes should first be addressed directly with salon management
- Mediation: If direct resolution fails, disputes may be submitted to mediation
- Arbitration: Binding arbitration may be required for disputes exceeding $5,000
- Small Claims Court: Disputes under $5,000 may be filed in small claims court
- Legal Action: Any legal action must be commenced within one year of the dispute arising
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
